21 1/1/1900NOTICEDated: 21st November, 2012 NOTICE It is brought to the notice of all members that on 16.11.2012 the Division Bench (constituting Hon’ble Mr. Justice Pradeep Nandrajog & Hon’ble Mr. Justice Manmohan Singh, JJ) of our Hon’ble High Court, in RFA (OS) 108/2012 titled as “Daya Kishan Goel Versus Ramesh Chander Goel & Ors.” rejected the applicability of enhanced Court Fees in appeals filed against orders and decrees passed in suits instituted before the Delhi Court Fees Amendment Act, 2012, took effect. In the above case, the Court has observed thus: “12……. with respect to appeals filed against orders and decrees passed in pending suits, court fees in appeal has to be paid with reference to the Court fee payable in the suit as per the Schedule existing when the suit was filed unless the amendment is given a retrospective operation, which we find not to be the case with reference to the legislation in Delhi. Thus, we direct the Registry not to insist on Court fees to be paid at enhanced rates with respect to decrees passed in suits which were instituted before the Delhi Court Fees Amendment Act 2012 was passed.”

The Hon’ble Chief Justice has assured us that the High Court shall consider our representation before proceeding further in the matter. The Executive Committee assures all its members that all steps necessary to safeguard the interest of the members of the Delhi High Court Bar Association are being taken and all the members shall be kept informed of all further action being taken in the matter. 23 1/1/1900NOTICE Dated: 22.11.2012 NOTICE The Executive Committee of Delhi High Court Bar Association has come to know that the Hon’ble Full Court yesterday has decided to make a recommendation to the Central Government to amend the Delhi High Court Act, 1966 by enhancing the original jurisdiction of this Hon’ble Court from Rs.20 lacs to 2 crores. The recommendation is stated to be in wake of the report of the committee to recommend pecuniary jurisdiction enhancement of the Delhi High Court but copy of the said report was never made available to the Executive Committee of the Delhi High Court Bar Association. The Executive Committee immediately took up the matter with Hon’ble The Chief Justice and thereafter had a meeting with the members of the Administrative Committee which comprised of 6-7 other Hon’ble Judges. During the course of our deliberations, it was brought to the notice of the Hon’ble Judges that the said committee report was not available with us nor we were given an opportunity to make any representation with respect thereto. The decision of the Full Court in effect tends to impair the Justice Delivery System of the High Court. The shine of Delhi High Court is on account of the judgments pronounced on the original jurisdiction of this Hon’ble Court which could not be possible without the assistance of the Bar. The nature of the litigation pending on the original side requires deft handling by experience and knowledge. Any enhancement of the jurisdiction would impede the growth of the Bar as by far most of our junior members get groomed on the original side. Enhancement of jurisdiction on the original side would also affect the quality of the judgments. The inconvenience caused to the litigant public by going from one court to another court was also brought to the notice of the Hon’ble Judges. The amendment to the Court Fees Act also has already had a deterrent effect on the filing of new litigation before the Delhi High Court. A review of the profile of pending matters on the original side of this Court does not warrant any such recommendation. Institution of cases in this court from 2008 to 2011 already shows a sharp decline in filing of fresh suits which have reduced from 2564 in 2008 to 437 in 2011. The High Court has lost many of its jurisdictions by creation of tribunals while one more is in the offing, namely; Environment tribunal which will also take away further jurisdiction from this court; we wonder then what will be left with the High Court to adjudicate upon? The Hon’ble Chief Justice was pleased to accept that on the representation being received from the Delhi High Court Bar Association, the same would be deliberated upon before the Full Court recommendation was sent to the Government. Fortunately, it was accepted that the report of the committee was not made available to us. We are willing to make our representation to the Hon’ble Judges on receipt of the same and we are confident that in case our submissions were considered under no circumstances would they agree to the enhancement of the pecuniary jurisdiction of this court. In case there are any apprehensions of the Hon’ble Judges, the Executive Committee is willing to allay any such apprehensions. The Hon’ble Chief Justice has been pleased to observe that whatever has been discussed with them today shall be considered by them and they shall revert back to us. On the deliberations, the Executive Committee shall make a representation to Hon’ble The Chief Justice and the same shall be communicated and circulated amongst the members of the Bar Association. The Executive Committee in its emergent meeting today resolved that it shall await the outcome of the deliberations today and the response of the Hon’ble Chief Justice and shall review the situation tomorrow i.e. Friday, 23rd November, 2012. Some of the members have expressed their reservation that any recommendation made by the Full Court would get implemented. The alleged resolution is at best a communication to the Government of India to frame a statutory amendment to the Delhi High Court Act, 1966, which will have to be amended by the legislature to implement the said proposal or resolution of the Full Court. The brusque remarks emanating from these benches for some senior lawyers of the Bar are demeaning not just for the individual but they lower the image of institution in the eyes of the litigants and the public at large. It has been specifically noticed that Hon’ble Mr. Justice Valmiki Mehta presently on the Original Side, is excessively harsh in imposing costs on an unprecedented scale, on the litigants and his Lordship’s demeanor on the Bench has been wanting of this august office. Despite, requests and representations to the Hon’ble Chief Justice and personal meetings with successive Chief Justices by the Office Bearers of the Executive Committee, which in no case would go unnoticed there is no sign of any carminative effect. Conspicuously it looks like that the Bar as a whole can be subjected to the caprices of any ‘knight errand’ despite the fact that it always conducts its business as prudent officers of the Court. Therefore, Executive Committee, has resolved: “(i) that a representation be sent by the Bar Association to the Hon’ble Chief Justice of Delhi High Court and to the Hon’ble Chief Justice of India and other members of the collegium requesting their Lordships that Hon’ble Mr. Justice Valmiki Mehta be not recommended for further extension of his tenure or for confirmation; (ii) that the President and Secretary be and hereby authorized to make the representations and also intimate the Hon’ble Chief Justice of Delhi High Court of this resolution; and (iii) resolved further that as a mark of protest, members of the Bar shall boycott the Court of Hon’ble Mr. Justice Valmiki Mehta on as date to be notified by the Honorary Secretary of the Bar Association.” However for the time being, it has been inter-alia resolved by the Executive Committee as follows: “..……..MEMBERS OF THE BAR SHALL BOYCOTT THE COURT OF HON’BLE MR. Murugesan Chief Justice High Court of Delhi New Delhi 110 503 Sub: NOTIFICATION OF THE HON’BLE HIGH COURT OF DELHI BEARING NO. 529/ RULES/ DHC DATED DECEMBER 14, 2012 REGARDING RULES FOR DESIGNATING AN ADVOCATE AS SENIOR ADVOCATE. Hon’ble Sir, 1. The aforementioned notification circulated few days ago though dated December 14, 2012, has a heavy compound of contradictions and is not in sync with the respect and esteem the designation in question commands or deserves. It is respectfully submitted that various aspects of the same need to be reconsidered. 2. We cannot forget the fundamental fact that an Advocate is designated as a Senior Advocate by virtue of his ability, standing at the Bar or special knowledge or experience in law. Any yardstick that has no direct nexus with the pre-eminence the designation carries will be an anathema. A designated Senior has to follow a dominant, but unwritten, code of maintaining the majesty of law and the dignity of courts. This calls for a kind of eminence, experience, learning and above all a matching conduct. Any rule regarding designation of an Advocate as a Senior Advocate has to keep this in sight and spirit. 3. Rule 2 (iii), prescribes that no person shall be designated as a Senior Advocate unless he has been mainly practising in the High Court of Delhi and the Courts Subordinate to it. Rule 2 (i) says that no person shall be designated as a Senior Advocate unless he has practised as an Advocate at the Bar for not less than ten years and the Rule 2 (iv) prescribes that no person shall be designated as a Senior Advocate unless he has furnished at least fifteen judgments, in the preceding three years, where he has contributed to the growth of law. 4. The above rules reflect conspicuously the contradictions, incohesiveness and irrelevance they bear. Primarily one has to have a practice of at least ten years; s/he has to be mainly practising in the High Court of Delhi and the Courts Subordinate to it. Does this not convey that a person, who has been practising at the High Court alone for over ten years with no practice at the subordinate courts, is not entitled to be designated? Then the desiring Advocate also has to furnish at least fifteen judgments, in the preceding three years, where he has contributed to the growth of law. This is, obviously, subjective and to some extent, contentious even. How could a lawyer practising mainly at the subordinate courts have fifteen judgments to his credit, and that too contributing to the growth of law? With due respect, it is submitted that if we take all the judgments of this Hon’ble Court as a whole for a year, we doubt, there would be fifteen judgments that have, in real sense, contributed to the growth of law. Aren’t we missing the woods for the trees? 5. Then there is a sanguine explanation given under Rule 2 that “the eligibility condition with regard to minimum standing as a practising Advocate shall not apply to retired Judicial Officers or those who have resigned having service and/or practice of 10 years at their credit and retired High Court Judges.” Fatality attains finality here as retired Judges of Hon’ble High Court and Judicial Officers - retired or resigned have been brought into one bundle. A judicial officer who resigns after a service duration of ten years has been brought at par with an Hon’ble Judge of the High Court who has put in decades of remarkable service and has had the opportunity of hearing many a senior counsel umpteen times! Rule 8 specifically allows that “a retired judge of a High Court entitled to practice in the Delhi High Court on his enrolment with the Bar Council of Delhi, may be designated as a Senior Advocate if he intimates the Chief Justice of his desire to be so designated.” In our humble submission, we are forgetting the underlying violation of Article 14 of the Constitution here. Or, are we trying to make someone more equal? Anomaly, thy name is the notification No.529/Rules/ DHC dated December 14, 2012! 6. There are two types of procedure for designation – a) suo moto designation (Rule No.4) and b) other than suo moto designation (Rule No.5). Category under Rule No.4 starts with the proposal by a Hon’ble Judge or Chief Justice, of an advocate. Thereafter the Hon’ble Chief Justice informally confers with twothird strength of the Judges and after consent by the Advocate concerned, the matter is placed before the Full Court for passing a formal resolution conferring the designation. Here, of course, the Advocate concerned has to fall in line with the conditions of Rule 2 and the explanation also applies. So far, so good and the story ends well here. 7. The second category of procedure envisaged by Rule 5 starts with the proposal being initiated and forwarded to the Registrar General jointly by five Senior Advocates designated by the High Court with not less than five years individual standing at the Bar as such! The proviso to this rule provides – “no such Senior Advocate shall propose more than two names in two consecutive considerations by the Full Court.” No more than two names in two consecutive considerations! The meaning is quite confusing. 8. Again, such a proposal has to meet consideration of the Full Court and win the voting by secret ballot. Secrecy is here the most sacrosanct, in a temple of justice, when one of its officers has to be given a distinct status on account of his standing at the Bar! The sole question that goes unconsidered is, in the whole process, what is the weightage given to the proposal by five Senior Advocates, and that too with no less than the stipulated five years individual standing? Even a scant regard to them is an invisible aspect. Rule 7 says that “if a proposal is not favourably considered by the Full Court, the concerned Advocate would not be eligible for being recommended for designation as a Senior Advocate for a period of one year from the date of such decision and intimation thereof will be sent to the proposers and the concerned Advocate.” Yes, only intimation is sent to the proposers, but not the reason as to how and why their proposal has failed! 9. Though it is clichéd saying that “the court and counsel are two wheels of the chariot of justice,” yet here it seems that the chariot is destined or decided to run with the wheel of court alone. The indifference to the proposal from five seniors is writ large inasmuch as the same has to go through the process with more microscopic scrutiny and then, at the end if it does not pass through the secret votes for whatever reason, that is not let open to the five proposers who are recognised by the court as ‘Seniors.’ When freedom has to break away from precedents and reforms have to be brought in against repeated circling of procedures and precedents, we are trying to create more whirlwinds of them forgetting the fundamental princeples of truth and justice. Does this not amount to insulting the ‘Seniors’ directly and indirectly? It is high time that we discarded such principles and procedures which tend to work injustice. Rule alone is not the thing. Right or wrong matters more. The rule has to be certain and just. 10. The net effect, my Lord, is that the designation, with such rules and processes, becomes something like a whimsical satire and the designated seniors are further hurt and humiliated when they do not even deserve to know as to why and how their proposal has failed! With such rules, neither a designated senior, who has some respect for his ‘robes’ would like to propose a colleague to take the silk nor for that matter an advocate with some standing at the Bar would like to seek the designation. Under such circumstances, taking the silk does not become an honour conferred on a member of the profession recognising exceptional merit, contribution, integrity and good character. The designation is seemingly creating a flock designed by someone, of someone and for someone alone! 11. If the process and designation should not slide into such a situation, it is our earnest appeal to your Lordship that the Rules so circulated may please be recalled forthwith and the executive representatives of this Bar may very kindly given an opportunity to elaborate the issues further, so that a more fruitful and meritoriented procedure could be put in place. We very humbly request your Lordship to do the needful without any loss of time and for such a corrective measure, the Bar as a whole shall remain grateful to your Lordship and your Hon’ble companion judges. It has been unanimously resolved that the Chief Justice, having not even had the courtesy to call the Executive to talk, the members shall continue to abstain themselves from appearing in the Hon’ble High Court on Thursday 28th May, 2013. All cafeterias in the complex of the High Court shall remain closed. Court No.1 i.e. Chief Justices’ Court shall continue to be boycotted till further orders. The Hon’ble Chief Justice and his companion Judges have resolved that the representation being made by Delhi High Court Bar Association opposing any proposal of the enhancement of original side pecuniary jurisdiction, being not called for and that there is sufficient material and grounds for withdrawing the Full Court’s opinion; the same shall be placed before the full court for consideration and hearing. On receipt of the above resolution, the Executive Committee has resolved to withdraw the resolutions dated 24th & 27th May 2013 and resume normal functioning of the High Court from tomorrow i.e. 29th May 2013. Copy of the letter received from the Registrar General quoting the said resolution is being forwarded to all authorities concerned for necessary action. Members having any material or necessary information which would help the Executive Committee to make these representations may kindly forward the same as soon as possible to Mr. J.P.Sengh (Vice President). 124 1/1/1900NOTICEDecember 4, 2012 NOTICE Enhancement of Original Side Jurisdiction The Executive Committee of Delhi High Court Bar Association has been taking up the matter with the Hon’ble Chief Justice, High Court of Delhi, with respect to a purported proposal to the Government to enhance the pecuniary jurisdiction of the High Court, which exclusively falls within the legislative competence of the Parliament. As notified to the members earlier, a detailed representation dated November 23, 2012, was made to the Hon’ble Chief Justice, which was also circulated amongst the members. Further, copy of a report of the Committee of Hon’ble Judges in this regard as well as other information/material that were placed before the Hon’ble Full Court are also awaited. Based on the above, the learned members are requested kindly to give their inputs and materials which would, in their opinion, strengthen the facts and stand of the Association. In the said representation, members must have noted that a specific request has been made to the effect that “pending consideration, we are sure that neither the minutes of this so-called proposal shall be drawn up nor signed by any of the Hon’ble Judges and in no event sent to the Government.” The matter is under consideration of the Hon’ble Chief Justice. As soon as his Lordship’s response is received, members shall be kept abreast of the same. However, it has come to light that some kind of apprehensions, unfounded views and comments are spreading amongst our members. The Executive Committee wishes to place on record that there is no cause for any such apprehension or misgivings; neither any of the office bearers nor any member of the Executive Committee has consented to the purported proposal. Please do not get carried away by such misinformation. Since the matter is under consideration of the Hon’ble Court, it is not at all proper to be up with such impressions, conjectures or surmises. We must bear in mind that jurisdiction of the High Court cannot be enhanced with just one proposal inasmuch as it is purely a legislative consequence which is within the domain of the Parliament alone. And, a proposal is not a finality in itself. A judicial function cannot extend itself to amending the law. A judgment of the Full Bench of 5 Judges of our High Court in this regard is operative as of date. The Executive Committee is hopeful that the Court will not move further in this regard as the Original Side of the High Court has always been an illustrious example and none would like to let it diminish or lower its strength by clipping its wings in the name of enhancement of jurisdiction. 143 1/1/1900NOTICE Date: 06.03.2013 NOTICE TV Channels today showed that the lawyers, the officers of the Hon’ble Court at Chandigarh and Jaipur have faced police brutality which has become the rule of the day for the Police. The Executive Committee of Delhi High Court Bar Association strongly condemns the high handedness of the police in freely using batons, lathis and water cannons at the peaceful demonstration of lawyers and also strongly condemns the unprecedented & brutal action of the police. As a mark of protest, members are requested to wear black ribbons while appearing in their cases tomorrow. Authorities are requested to take stern action against the erring officials. Hon’ble Chief Justices of both the High Courts are requested to take suo motto action in the matter, as the officers of the court have been brutally beaten by the protectors of law. The Executive is keeping in touch with the Executive Committees of the Bar Associations at Chandigarh and Jaipur and would review the situation. Copy of this resolution is being sent to the Hon’ble Chief Justice of India, the Hon’ble Chief Justices of the Punjab & Haryana and the Rajasthan High Court for initiating appropriate action. This year again, on the overwhelming demand for the same, Aadhaar Enrolment Centre has been opened from Saturday, 20th April, 2013 in the Caretaker’s Room, Chamber Block I, (Entry from the side of DHCBA Office), for the facility of the Members, Staff and others associated with the Delhi High Court. The camp shall be open for a month i.e. 20th May, 2013. I request all to avail this facility.
